In a decision issued March 30, 2017, Judge Janet Sanders of the Suffolk Superior Court accepted the position advanced by Quat Law Offices and co-counsel that LVNV Funding, LLC has been unlawfully collecting debts in Massachusetts because it is not licensed by the Division of Banks as a debt collector. The Court explained that "debt buyers" such as LVNV are not exempt from the licensing requirement simply because its debts are placed for collection with collection agencies and law firms. As a result of this ruling, anecdotal evidence indicates that LVNV has ceased filing and prosecuting lawsuits in Massachusetts courts.
